FINAL PUBLIC NOTICE

COASTAL ZONE SOUTH 9TH STREET

ROADRAISING AND DRAINAGE IMPROVEMENT PROJECT

This is to give notice that the Village of Lindenhurst has applied for United States Housing and Urban Development, Community Development Block Grant funds through the Town of Babylon Community Development Agency for the proposed Coastal Zone Flood Mitigation Project on South 9th Street from Montauk Highway south to Strong’s Creek.  This project is located within the 100-year Floodplain and Wetland.

This notice is required by Section 2(a)(4) of Executive Order 11988 for Floodplain Management, and by Section 2(b) of Executive Order 11990 for the Protection of Wetlands, and is implemented by HUD Regulations found at 24 CFR 55.20(b) for the HUD action that is within and/or affects a floodplain or wetland.

On May 13, 2008 the Lindenhurst Planning Board determined that there will be no significant environmental impact regarding the subject project.  The Lindenhurst Village Board held a public hearing on May 20, 2008.  Since then a New York State Department of Environmental Conservation Permit has been obtained.  All contract documents have been finalized.  On February 26, 2009 another public informational hearing was held allowing for additional public comments.  After reviewing public comments the Village of Lindenhurst has no practicable alternative except to proceed with the subject project.
